1. About these terms

These Terms of Service apply to your use of this website and to the earthworks and civil services provided by All Type Plant Hire (29 898 725 180) ("we", "us", "our"), including site cuts, pads, trenching, retaining walls, land clearing and site preparation for residential and commercial clients.

By using our website, requesting a quote or engaging our services, you agree to these terms. If a written quote, contract or hire agreement we give you says something different, that document applies to the extent of the difference.

2. Using our website

The information on this website is general in nature and is provided to help you understand our services. We work to keep it accurate and current, but we don't guarantee that all content is complete or error-free, and we may update it at any time without notice.

You must not use this website for any unlawful purpose, or in a way that could damage, disable or interfere with it.

3. Quotes

Quotes are based on the information you give us and on what we can reasonably see of the site at the time of quoting. Unless stated otherwise, quotes are valid for 30 days from the date issued.

A quote is accepted when you confirm in writing (including by email or text) or when you allow work to begin.

4. Site conditions and variations

Some site conditions can't be seen before work starts, such as rock, unsuitable or contaminated material, hidden obstructions, groundwater or undisclosed services. If we come across conditions like these, or if you ask for extra work, the price and timeframe may change.

Where practical, we will tell you about any variation and agree on it with you before carrying out the additional work.

5. Your responsibilities

Unless we agree otherwise in writing, you are responsible for:

Providing safe, clear and legal access to the site for our people, machinery and trucks.
Telling us about any known underground or overhead services, including private services such as water, power, sewer, stormwater and irrigation lines on your property.
Confirming property boundaries and providing survey pegs or set-out where required.
Obtaining any council approvals, permits or consents needed for the work.
Making sure the information you give us is accurate.

We will request service location information through Before You Dig Australia where appropriate. However, these records don't always show private services, so the information you provide is important.

6. Payment

Unless your quote states otherwise, invoices are payable within [7] days of the invoice date. We may require a deposit before booking larger jobs. All prices include GST unless stated otherwise.

If an invoice is overdue, we may pause work until payment is made, and we may recover reasonable costs incurred in collecting the overdue amount.

7. Cancellations, rescheduling and weather

If you need to cancel or reschedule booked work, please give us at least [24 hours'] notice. Cancellations with less notice, or where machinery has already been sent to your site, may incur a cancellation fee to cover our costs.

Wet weather and ground conditions can make work unsafe or cause damage to your site. If we decide that conditions aren't suitable, we will reschedule the work at no extra charge.

8. Safety

We carry out all work in line with Queensland work health and safety requirements. We may stop or decline work if we believe the site or the requested work is unsafe, and we will discuss options with you to resolve the issue.

9. Liability

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms limits any rights you have under that law.

To the extent permitted by law:

Our liability for any service that fails to meet a consumer guarantee is limited to supplying the service again or paying the cost of having it supplied again.
We are not liable for indirect or consequential loss, including loss of profit, revenue or use.
We are not liable for damage to underground or concealed services that were not disclosed to us or not shown in service location records, where we have taken reasonable care.

10. Insurance

We hold public liability insurance. Details of our cover are available on request.

11. Intellectual property

All content on this website, including text, photos, graphics and logos, belongs to All Type Plant Hire or is used with permission. You may not copy, reproduce or use it for commercial purposes without our written consent.

12. Privacy

We collect and handle your personal information in line with our Privacy Policy.

13. Links to other websites

Our website may link to other websites. We are not responsible for the content, accuracy or practices of those websites.

14. Changes to these terms

We may update these terms from time to time. The current version will always be published on this page, with the date it was last updated.

15. Governing law

These terms are governed by the laws of Queensland, Australia. You and we agree to submit to the jurisdiction of the courts of Queensland.
